Note: Please read the terms set out below in order to use this website. Every natural and legal person who benefits from the services offered on valide.org.tr or who accesses valide.org.tr in any manner is deemed to have accepted the following terms of use.

Terms of Use

The activities and services offered on valide.org.tr are provided by Valide Humanitarian Aid Association; the legal owner of valide.org.tr is Valide Humanitarian Aid Association, and all rights of use and disposal over valide.org.tr belong to Valide Humanitarian Aid Association.

Valide Humanitarian Aid Association may amend these terms of use whenever necessary; however, such amendments shall be published regularly on valide.org.tr and shall take effect from that date. Every natural and legal person who benefits from the services of valide.org.tr and accesses valide.org.tr is deemed to have accepted in advance every amendment made by Valide Humanitarian Aid Association to the provisions of these terms of use. Valide Humanitarian Aid Association reserves the right to change at any time the information, forms and content that are or will be included on this website.

Definitions

SITE (valide.org.tr): The website accessible through an online environment in which various services and content are offered within the framework determined by Valide Humanitarian Aid Association.

MEMBER: Every natural and legal person who wishes to benefit from the donation campaigns of Valide Humanitarian Aid Association, who completes the membership form they have selected in full, and whose membership is approved and accepted by Valide Humanitarian Aid Association. They shall be referred to briefly as “MEMBER” in this agreement. Individuals who have reached the age of 18 may become members by completing the relevant membership form on valide.org.tr in full with their genuine identity information.

USER: A person who visits the Valide Humanitarian Aid Association website (valide.org.tr) with or without making a donation.

DONOR: A person who makes a donation to Valide Humanitarian Aid Association through the website.

LINK: A connection enabling access from valide.org.tr to another website, files or content, or from another website to valide.org.tr, its files and content.

CONTENT: All kinds of information, files, images, programs, figures, prices and other visual, written and audio material published on or accessible through valide.org.tr and/or any website.

WEBSITE TERMS OF USE AND MEMBERSHIP AGREEMENT: This agreement concluded electronically between Valide Humanitarian Aid Association and natural and/or legal persons who will benefit from the commercial and personalised services offered through valide.org.tr.

PERSONAL INFORMATION: Information such as the Member’s identity, address, e-mail address, telephone number, IP address, which sections of valide.org.tr they visit, domain type, browser type, date and time of visit.

Scope of Services

An ordered display of the donations and dues made by a donor who donates through web membership.

General Provisions

Links may be provided through valide.org.tr to other websites and/or other content that are not under the control of Valide Humanitarian Aid Association and that are owned and operated by third parties. These links are provided in order to facilitate navigation for USERS and MEMBERS and do not constitute an endorsement of any website or of the person operating that site. They do not constitute any representation or warranty of any kind regarding the information contained on the linked website. Valide Humanitarian Aid Association bears no responsibility for the websites and content accessed through links on valide.org.tr, and any damage that may arise from the use of those sites is the responsibility of the USERS and MEMBERS themselves. Valide Humanitarian Aid Association may make access to such linked websites subject to its written consent, and may at any time block access to links it deems inappropriate.

Valide Humanitarian Aid Association continuously checks the accuracy and currency of the information available on valide.org.tr. However, despite the efforts made, the information on valide.org.tr may lag behind actual changes. The material and information contained on valide.org.tr is presented as at the time it was provided to valide.org.tr.

The USER and MEMBER accept that the files, information and documents on valide.org.tr available for download and/or sharing may not have been cleared of viruses, worms, trojans, dialer programs, spam, spyware or any other malicious and harmful code or material, and that valide.org.tr gives no warranty in these respects. It is entirely the responsibility of the USER and the MEMBER to meet all software and hardware requirements, and to carry out their maintenance and updates, in order to prevent such malicious and harmful programs, code or material, to ensure the accuracy of data input and output, and to recover any lost data. Valide Humanitarian Aid Association is not liable for any damage that the USER, the MEMBER or third parties may suffer as a result of data inaccuracies or losses that such malicious programs, code or material may cause.

Valide Humanitarian Aid Association reserves the right to change, without prior notice, all kinds of services and activities available on this website and its extensions, together with the terms of use of valide.org.tr and the information offered on valide.org.tr; to reorganise valide.org.tr and its content; and to suspend and/or pause publication. Amendments take effect upon their publication on valide.org.tr. By using valide.org.tr or accessing valide.org.tr, these amendments are also deemed accepted. These terms also apply to other linked web pages. Valide Humanitarian Aid Association accepts no liability whatsoever in respect of interruption of a transaction, error, omission, suspension, deletion, loss, delay in a transaction or communication, computer virus, communication failure, theft, destruction, or unauthorised access to, alteration or use of records, arising as a result of breach of contract, tort, negligence or other causes.

Neither Valide Humanitarian Aid Association, nor the institutions with which it cooperates, nor its employees and managers bear any responsibility for the services provided and content published by third parties within valide.org.tr.

The undertaking as to the accuracy and lawfulness of information, content, and visual and audio material provided and published by any third party rests entirely with the third parties carrying out those acts. Valide Humanitarian Aid Association does not undertake the security, accuracy or lawfulness of the services and content provided by third parties.

Those who use valide.org.tr may carry out transactions on valide.org.tr only for lawful and personal purposes. USERS and MEMBERS bear their own legal and criminal liability for every transaction and act they perform within valide.org.tr. Every USER and every MEMBER undertakes not to engage in any activity that would constitute an infringement of the rights of Valide Humanitarian Aid Association and/or any other third party. Valide Humanitarian Aid Association bears no direct and/or indirect liability for damage suffered or that may be suffered by third parties as a result of the activities of USERS and MEMBERS on valide.org.tr.

The owner of this website is Valide Humanitarian Aid Association. The information, texts, images, trademarks, slogans and other signs on this website, together with the programs for the protection of information relating to other industrial and intellectual property rights, the page layout and the presentation of valide.org.tr, are the property of Valide Humanitarian Aid Association or of the organisations from which Valide Humanitarian Aid Association has obtained permission and licence. It is prohibited to copy, alter, publish, transmit, distribute or sell, in whole or in part, whether online or through any other medium, the information on this website, any database relating to the pages of valide.org.tr, the website, the HTML code and other code of software, and the products, designs, images, texts, visual, audio and other material, video clips, files, catalogues and lists contained in the content of valide.org.tr. Valide Humanitarian Aid Association may use the information transmitted to it by USERS and MEMBERS through valide.org.tr in accordance with the provisions of the “Privacy Policy” and the “Website Terms of Use”. It may process this information and classify and retain it in a database. Valide Humanitarian Aid Association may also use information such as the identity, address, e-mail address, telephone number and IP address of the USER and MEMBER, which sections of valide.org.tr they visit, domain type, browser type, and date and time of visit, for purposes such as statistical evaluation, announcing campaigns and offering personalised services. Personal information belonging to USERS and MEMBERS shall not be disclosed to natural and legal third parties, except upon the request of authorities empowered by law and in the cases listed below. Personal information is, on rare occasions, provided to third parties acting for or on behalf of Valide Humanitarian Aid Association, or to those connected with the work of Valide Humanitarian Aid Association, in order to better process the original purposes of use of the data or to provide better service in accordance with the purposes proposed by USERS and MEMBERS.

Except where expressly authorised by Valide Humanitarian Aid Association within these Terms of Use of valide.org.tr, Valide Humanitarian Aid Association reserves all its rights in respect of the ASSOCIATION’s services, information, works subject to its copyright, activities, and other assets and information provided through this website.

Limitation of Liability

Valide Humanitarian Aid Association is not liable for any direct or indirect damage that may arise from access to valide.org.tr or from the use of valide.org.tr or of the information, other data and programs on valide.org.tr, whether based on breach of contract, tort or other grounds. Valide Humanitarian Aid Association accepts no liability whatsoever in respect of interruption of a transaction, error, omission or suspension arising as a result of breach of contract, tort, negligence or other causes. It is accepted that, by accessing this website or other linked websites or by using valide.org.tr, Valide Humanitarian Aid Association is released from all liability and from all claims for damages and rights of claim, including court and other costs, that may arise as a result of such use or visit.

Assignment of the Agreement

Valide Humanitarian Aid Association may assign this agreement, in whole or in part, at any time without notice. However, the USER and MEMBER may not assign this agreement or any part of it to another party. Any such attempted assignment is invalid.

Force Majeure

In all circumstances deemed force majeure at law, Valide Humanitarian Aid Association is not liable for late performance or non-performance of these “WEBSITE TERMS OF USE”. Such circumstances shall not be deemed delay, non-performance or default on the part of Valide Humanitarian Aid Association, and no obligation to pay compensation shall arise for Valide Humanitarian Aid Association in such cases.

Governing Law and Jurisdiction

Disputes arising from these “WEBSITE TERMS OF USE AND MEMBERSHIP AGREEMENT” are subject to Turkish law, and the Central Courts and Enforcement Offices of İstanbul have jurisdiction. The right of Valide Humanitarian Aid Association to bring an action in the country where the USER and MEMBER are located is reserved.

Entry into Force and Acceptance

These “WEBSITE TERMS OF USE AND MEMBERSHIP AGREEMENT” enter into force on the date they are announced by Valide Humanitarian Aid Association within the content of valide.org.tr. USERS and MEMBERS accept the provisions of this agreement by using valide.org.tr. Valide Humanitarian Aid Association may amend the provisions of this agreement at any time; amendments are published on valide.org.tr stating the version number and date of amendment, and enter into force on the same date.
